By accessing or using PhotosShoot at https://www.photosshoot.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.

2. Description of Service

PhotosShoot is an AI-powered photo generation platform that allows users to create AI models from uploaded photos, generate images using various AI providers, organize photos into packs, and create AI-generated videos.

3. Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account

4. User Content

Uploaded Photos

• You must own the rights to all photos you upload or have explicit permission from the rights holder
• You must not upload photos of minors
• You must not upload photos of other people without their consent
• You retain ownership of your uploaded photos

Generated Content

• You own the images and videos generated through our service
• You are responsible for how you use generated content
• You must not use generated content to deceive, defraud, or harass others
• You must not create deepfakes or non-consensual intimate imagery

5. Prohibited Uses

You agree not to use our service to:

• Generate illegal, harmful, or abusive content
• Create non-consensual intimate or explicit imagery of real people
• Impersonate others or create misleading content
• Generate content that promotes violence, hate speech, or discrimination
• Violate any applicable laws or regulations
• Circumvent any rate limits, security measures, or access controls
• Resell or redistribute the service without authorization
• Use automated scripts or bots to access the service

6. Payments and Refunds

• Paid plans are billed in advance on a recurring basis
• Credits are non-transferable and may expire according to your plan terms
• Refunds are handled on a case-by-case basis within 14 days of purchase
• We reserve the right to change pricing with 30 days notice
• Failed model trainings may be eligible for credit refunds

7. AI Model Training

• Model training times are estimates and may vary
• We do not guarantee specific results from AI-generated content
• Trained models are for your personal use within our platform
• We may use third-party AI providers (Replicate, Banana, Google, OpenAI) to process your requests

8. Intellectual Property

The PhotosShoot platform, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without permission.

9. Limitation of Liability

PhotosShoot is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time. Upon termination, your right to use the service ceases and we may delete your data after a reasonable retention period.

11. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance. We will notify users of material changes via email or in-app notification.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of Delaware.
